Terms and Conditions

Effective date: 20 May 2026

These Terms and Conditions ("Terms") govern your use of KwikQuote, a service operated by KwikQuote (Pty) Ltd ("KwikQuote", "we", "us"), a private company registered in the Republic of South Africa. By creating a KwikQuote account or using the service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.

1. The service

KwikQuote helps South African tradespeople turn customer WhatsApp messages into branded PDF quotes, generate payment links via PayFast, and send automated payment reminders. The service is offered through the website at kwikquote.co.za and through a WhatsApp Business assistant number operated by KwikQuote.

You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. Notify us immediately at support@kwikquote.co.za if you suspect any unauthorised access.

4. Free trial

New accounts include a 14-day free trial of the Pro plan with no credit card required. At the end of the trial, your account becomes read-only until you choose a paid plan. We will email you before your trial ends.

6. AI-generated quotes — your review is required

KwikQuote uses AI to draft quote content from your forwarded messages. Every draft is your responsibility. You must review each quote, correct any errors, and confirm pricing before sending it to your customer. The AI can misread voice notes, miss context, get materials wrong, or produce numbers that look right but are not. KwikQuote provides the draft; the commercial decision is yours.

You agree that KwikQuote is not liable for any loss, dispute, or expense arising from an inaccurate quote, an under-quoted job, an over-quoted job, or any other error in extracted content.

7. Your customers

The relationship between you and your customers — including the validity of quotes, scope of work, warranties, refunds, disputes, consumer-rights obligations under the Consumer Protection Act, and the lawful basis for sharing their personal information with KwikQuote — remains yours. KwikQuote is a tool you use; KwikQuote is not a party to any agreement between you and your customer.

You agree not to use KwikQuote to:

9. WhatsApp messaging

KwikQuote sends messages on your behalf through Meta's WhatsApp Business Cloud API. Outbound messages outside a customer's 24-hour service window must use Meta-approved templates; we manage this for you. Meta may suspend or rate-limit messaging if recipients mark messages as spam or block the number. Repeated abuse may lead to your account being suspended.

10. Service availability

KwikQuote is provided on a best-effort basis. We do not commit to a service-level agreement. We may schedule maintenance windows and will attempt to give reasonable notice for planned downtime. Outages of third-party providers (Meta, PayFast, Anthropic, OpenAI, Supabase, Cloudflare) may temporarily affect functionality and are outside our control.

11. Intellectual property

KwikQuote, the KwikQuote brand, the application code, the website, and our quote templates remain the property of KwikQuote (Pty) Ltd. You retain ownership of the content you upload (logo, banking details, customer messages, your own templates). You grant KwikQuote a non-exclusive licence to host, process, and transmit that content for the purpose of providing the service to you.

12. Limitation of liability

To the maximum extent permitted by law:

Nothing in these Terms excludes liability that cannot be lawfully excluded under South African law, including under the Consumer Protection Act, 68 of 2008.

13. Suspension and termination

We may suspend or terminate your account if you breach these Terms, fail to pay subscription fees after the dunning retries described in Section 5, or use the service in a way that exposes us to legal or operational risk. We will give reasonable notice except where immediate action is required to protect KwikQuote or third parties. On termination you may request an export of your data for up to 30 days.

14. Changes to these Terms

We may update these Terms from time to time. The "Effective date" at the top of this page shows the latest revision. Material changes will be communicated by email to active subscribers at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.

15. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising under or in connection with these Terms is subject to the non-exclusive jurisdiction of the South African courts. Before initiating legal proceedings, you agree to first contact us in good faith at support@kwikquote.co.za so that we can attempt to resolve the dispute informally.
